1. Introduction and Acceptance

Welcome to Trekking Miles. These Terms and Conditions ('Terms') govern your access to and use of the Trekking Miles platform, including our website (www.trekkingmiles.com), mobile application, and all related services (collectively, the 'Platform').

These Terms constitute a legally binding agreement between you ('User', 'Traveller', or 'Host') and Trekking Miles Adventure Tours LLP ('Trekking Miles', 'Company', 'we', 'us', or 'our'), a Limited Liability Partnership registered under the Limited Liability Partnership Act, 2008.

By accessing, browsing, registering on, or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease use of the Platform.

We reserve the right to amend these Terms at any time. Continued use of the Platform after such amendments constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or a notice on the Platform.

2. Definitions

'Platform' refers to the Trekking Miles website, mobile application, and all associated digital services.

'Traveller' refers to any individual who browses, books, or participates in any experience listed on the Platform.

'Host' refers to any individual, business, cooperative, or community group that lists an experience, activity, stay, or service on the Platform.

'Experience' refers to any activity, tour, stay, farm visit, wellness retreat, cultural programme, adventure activity, or other offering listed by a Host on the Platform.

'Booking' refers to a confirmed reservation made by a Traveller for an Experience.

'Listing' refers to the page created by a Host on the Platform describing their Experience.

'Content' refers to all text, images, videos, reviews, descriptions, and other materials submitted to or displayed on the Platform.

'GST' refers to Goods and Services Tax as applicable under Indian law.

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age. Users between 13 and 18 years of age may use the Platform only with the active supervision and consent of a parent or legal guardian.
  • Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
  • Not be barred from receiving services under applicable laws of India or any other jurisdiction.
  • Provide accurate, complete, and current information during registration and throughout your use of the Platform.

Trekking Miles reserves the right to refuse access, suspend, or terminate accounts at its sole discretion if eligibility criteria are not met.

4. Account Registration and Security

To access certain features of the Platform, including booking Experiences or listing as a Host, you must create an account. When registering, you agree to:

  • Provide accurate, truthful, and complete information including your full name, valid email address, and contact number.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Keep your login credentials confidential and not share them with any third party.
  • Immediately notify us at Support@trekkingmiles.com of any unauthorised use of your account.

You are solely responsible for all activities that occur under your account. Trekking Miles shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms, associated with fraudulent activity, or inactive for an extended period.

5. Role of Trekking Miles

Trekking Miles operates as an online marketplace and intermediary platform that connects Travellers with Hosts offering sustainable travel experiences across India. We are not a travel agency, tour operator, or direct service provider for the Experiences listed on the Platform.

Unless expressly stated otherwise:

  • Trekking Miles does not own, operate, manage, or control the Experiences listed on the Platform.
  • The contractual relationship for the Experience is directly between the Traveller and the Host.
  • Trekking Miles acts as a limited payment collection agent on behalf of Hosts for the sole purpose of processing Booking payments.

While we endeavour to verify Host credentials, screen Listings, and maintain quality standards, we do not guarantee the accuracy, completeness, legality, safety, or suitability of any Experience. Travellers are encouraged to independently verify all details before booking.

6. Bookings and Payments

6.1 Booking Process

A Booking is confirmed only upon receipt of full or partial payment as specified in the Listing and issuance of a Booking confirmation by Trekking Miles. An itinerary request or enquiry does not constitute a confirmed Booking.

By completing a Booking, the Traveller agrees to the Host's specific terms, timings, inclusions, exclusions, and any activity-specific requirements stated in the Listing.

6.2 Pricing and Taxes

All prices displayed on the Platform are in Indian Rupees (INR) unless otherwise stated. Prices are inclusive of applicable GST unless explicitly indicated otherwise. International travellers are responsible for any currency conversion fees charged by their bank or payment provider.

Final pricing for customised or itinerary-based Experiences will be confirmed in writing prior to payment. Prices quoted during enquiry are indicative and subject to change until Booking confirmation.

6.3 Payment

Payments are processed through secure third-party payment gateways (Razorpay or equivalent). By making a payment, you authorise Trekking Miles to collect the Booking amount on behalf of the Host. Trekking Miles does not store credit/debit card information.

In cases of payment failure or dispute, please contact Support@trekkingmiles.com within 48 hours of the transaction.

6.4 Booking Confirmation

Upon successful payment, a Booking confirmation will be sent to your registered email address. It is your responsibility to verify the details in the confirmation. Any discrepancies must be reported to us within 24 hours.

7. Cancellation and Refund Policy

7.1 Cancellation by Traveller

Cancellations must be submitted in writing via email to Support@trekkingmiles.com. The following standard cancellation policy applies unless a Host specifies different terms in their Listing:

  • Cancellation more than 14 days before the Experience date: 90% refund of the Booking amount.
  • Cancellation 7–14 days before the Experience date: 50% refund of the Booking amount.
  • Cancellation less than 7 days before the Experience date: No refund.
  • No-show on the day of the Experience: No refund.

Note: Platform convenience fees and payment gateway charges are non-refundable in all cases.

7.2 Cancellation by Host

If a Host cancels a confirmed Booking, the Traveller will receive a full refund of the Booking amount paid to Trekking Miles. Trekking Miles will make reasonable efforts to suggest an alternative Experience, but is not obligated to do so.

7.3 Cancellation due to Force Majeure

In the event of cancellation due to circumstances beyond reasonable control — including natural disasters, floods, cyclones, pandemics, government-imposed restrictions, or other force majeure events — Trekking Miles will work in good faith with both Traveller and Host to offer rescheduling or a credit note. Refunds in such cases will be at the discretion of Trekking Miles and the Host, subject to applicable law.

7.4 Refund Processing

Approved refunds will be credited to the original payment source within 7–10 business days, subject to the timelines of the payment gateway. Trekking Miles is not responsible for delays caused by banking systems or payment providers.

8. Host Terms and Obligations

8.1 Listing Your Experience

Hosts may apply to list their Experiences on the Platform by completing the Host registration form. All Listings are subject to review and approval by Trekking Miles. Approval is at the sole discretion of Trekking Miles and may be withheld or revoked without prior notice.

By listing an Experience, the Host warrants that:

  • All information provided in the Listing is accurate, truthful, and not misleading.
  • The Host holds all necessary licences, permits, insurance, and regulatory approvals required to offer the Experience in India.
  • The Experience complies with all applicable laws including those related to tourism, food safety, environmental protection, and consumer rights.
  • The Host has the legal right to list and provide the Experience without infringing on any third-party rights.

8.2 Host Responsibilities

Hosts are solely responsible for:

  • The quality, safety, and delivery of the Experience as described in the Listing.
  • Ensuring adequate safety measures, equipment, and supervision for all activities, particularly adventure or outdoor experiences.
  • Maintaining appropriate insurance coverage for their operations and participants.
  • Complying with all applicable local, state, and central government regulations.
  • Managing and responding to Traveller communications in a timely and professional manner.
  • Informing Trekking Miles promptly of any changes to the Experience, pricing, availability, or cancellations.

8.3 Host Payouts

Trekking Miles will remit Host payouts after deduction of the applicable platform commission as agreed upon during Host onboarding. Payouts are processed within 3–5 business days after the Experience date, subject to no pending disputes or claims by the Traveller.

8.4 Content Standards

Hosts agree that all Listing content, photographs, videos, and descriptions submitted to the Platform:

  • Are owned by the Host or the Host has obtained all necessary rights and permissions to use them.
  • Do not infringe any intellectual property rights, privacy rights, or applicable laws.
  • Are not false, misleading, offensive, discriminatory, or in violation of community standards.

Trekking Miles reserves the right to edit, remove, or decline any Listing content that does not meet our standards.

9. Traveller Responsibilities

As a Traveller using the Platform, you agree to:

  • Provide accurate and complete information during booking, including the correct number of participants, age group, and any relevant medical or accessibility conditions.
  • Read and comply with all instructions, safety briefings, house rules, and codes of conduct specified by the Host for each Experience.
  • Arrive on time for scheduled Experiences. Late arrivals may result in forfeiture of the Experience without refund.
  • Treat Host communities, local environments, wildlife, and cultural practices with respect and sensitivity.
  • Not engage in any illegal, disruptive, or harmful behaviour during the Experience.
  • Follow all safety guidelines and use safety equipment provided by the Host.
  • Not carry prohibited items including alcohol (unless explicitly permitted), drugs, weapons, or any item that may endanger other participants or the environment.
  • Obtain adequate travel insurance covering medical emergencies, trip cancellations, and adventure activities where applicable.

Failure to comply with these responsibilities may result in removal from the Experience without refund and may lead to account suspension.

10. Responsible and Sustainable Tourism

Trekking Miles is committed to sustainable and responsible travel. By using our Platform, all users agree to uphold the following principles:

  • Minimise environmental impact — carry back all waste, avoid single-use plastics, and follow Leave No Trace principles.
  • Respect local cultures — dress appropriately, seek permission before photographing community members, and follow local customs.
  • Support the local economy — purchase from local artisans and community enterprises wherever possible.
  • Protect wildlife and natural habitats — do not disturb, feed, or capture wild animals; do not pick plants or damage natural features.
  • Follow designated trails and paths — trespassing on private or restricted land is strictly prohibited.

Trekking Miles reserves the right to remove from the Platform any Host or Traveller found to be acting in a manner inconsistent with responsible tourism principles.

11. Intellectual Property

All content on the Platform including the Trekking Miles logo, brand name, website design, text, graphics, photography, software, and other materials ('Trekking Miles Content') are the exclusive intellectual property of Trekking Miles Adventure Tours LLP or its licensors and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Trekking Miles Content without our prior written consent.

By submitting Content to the Platform (reviews, photos, descriptions), you grant Trekking Miles a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and distribute such Content for platform operations and promotional purposes. You warrant that you own or have the right to submit such Content.

12. Reviews and User Content

Trekking Miles encourages Travellers to submit honest reviews of Experiences. Reviews must be:

  • Based on genuine, first-hand experience of the listed Experience.
  • Accurate and not contain false or misleading statements.
  • Respectful — free from personal attacks, discriminatory language, offensive content, or threats.
  • Not in exchange for any form of payment, discount, or incentive from the Host.

Trekking Miles reserves the right to remove, edit, or decline any review that violates these standards or our community guidelines. We do not alter the substance of reviews to benefit Hosts.

Hosts may not post reviews of their own Experiences or incentivise Travellers to submit positive reviews.

13. Disclaimer and Limitation of Liability

13.1 Disclaimer

The Platform and all content on it are provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied. Trekking Miles does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Trekking Miles does not endorse, guarantee, or assume responsibility for any Experience listed on the Platform. Travellers participate in Experiences at their own risk, particularly in adventure, outdoor, or physical activities.

13.2 Limitation of Liability

To the fullest extent permitted by applicable law, Trekking Miles and its directors, officers, employees, and agents shall not be liable for:

  • Any personal injury, death, or property damage arising out of or in connection with any Experience.
  • Any indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.
  • Any loss of data, revenue, profits, or goodwill arising from Platform use.
  • The acts, omissions, or defaults of any Host, Traveller, or third-party service provider.
  • Any force majeure events including natural disasters, government actions, or pandemics.

Where liability cannot be excluded by law, Trekking Miles' total aggregate liability shall be limited to the Booking amount paid by the Traveller in connection with the specific Experience giving rise to the claim.

13.3 Indemnification

You agree to indemnify, defend, and hold harmless Trekking Miles and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Prohibited Conduct

Users of the Platform agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Submit false, misleading, or fraudulent information, bookings, reviews, or listings.
  • Impersonate any person or entity or misrepresent your identity or affiliation.
  • Circumvent the Platform by directly contacting Hosts discovered through Trekking Miles to book outside the Platform for the purpose of avoiding platform fees.
  • Collect or harvest personal data of other users without consent.
  • Post, transmit, or distribute any content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
  • Attempt to gain unauthorised access to any part of the Platform or its related systems.
  • Use bots, scrapers, or automated tools to access the Platform without prior written consent.
  • Engage in any conduct that disrupts, damages, or impairs the Platform's functionality.

Violation of any of the above may result in immediate account suspension, removal of Listings, forfeiture of pending payouts, and where appropriate, referral to law enforcement authorities.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872; the Consumer Protection Act, 2019; the Information Technology Act, 2000; and the Digital Personal Data Protection Act, 2023.

15.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Platform, the parties agree to first attempt resolution through good-faith negotiation and mediation. Grievances may be raised through our Grievance Officer.

If a dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.

For consumer disputes, Travellers retain the right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

16. Grievance Officer

In accordance with the Consumer Protection Act, 2019 and the Information Technology Act, 2000, a Grievance Officer has been designated to address User complaints:

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any Booking-specific terms, constitute the entire agreement between you and Trekking Miles with respect to the Platform and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions.

17.3 Waiver

No waiver of any provision of these Terms shall be effective unless in writing. A waiver on one occasion shall not be deemed a waiver on any subsequent occasion.

17.4 Assignment

You may not assign or transfer any rights or obligations under these Terms without the prior written consent of Trekking Miles. We may assign our rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including acts of God, natural disasters, pandemics, government actions, war, terrorism, or civil unrest.
